These Terms and Conditions govern all orders placed through the online shop harialy.ch within Switzerland and Liechtenstein.

harialy.ch offers selected outdoor, design and lifestyle products from various brands for indoor and outdoor use.

1. Provider and Scope

  • The provider of the online shop is Patrisol GmbH, Schulstrasse 3, CH-8597 Landschlacht, Switzerland. 
  • These Terms and Conditions apply to all orders placed via harialy.ch. 
  • The offer is intended for customers in Switzerland and Liechtenstein. 
  • By placing an order, the customer accepts these Terms and Conditions. 

2. Products and Brands

  • harialy.ch offers products from selected brands such as OUTBAG, SACKit, TRIMM Copenhagen and other lifestyle and outdoor brands. 
  • Depending on the product, items are suitable for indoor and/or outdoor use. 
  • Product images, colours and materials may vary slightly depending on screen settings and display quality. 
  • Materials, fabrics and surfaces may show slight variations due to production or material-specific characteristics. 
  • Information regarding dimensions, weight, materials and functions is provided to the best of our knowledge but without guarantee. 

3. Prices, VAT and Shipping Costs

  • All prices are stated in Swiss Francs (CHF) and include applicable VAT. 
  • Shipping costs are displayed separately during the checkout process. 
  • Promotional prices or discounts apply only during the specified promotional period. 
  • Prices and product assortments are subject to change without notice. 

4. Orders and Conclusion of Contract

  • Orders are placed via the shopping cart on harialy.ch. 
  • Before submitting an order, customers may review and modify products, quantities and addresses. 
  • After the order has been submitted, the customer receives an automatic confirmation by e-mail. This confirmation does not yet constitute acceptance of the offer. 
  • The contract is concluded only upon shipment confirmation or delivery of the goods. 
  • harialy.ch reserves the right to reject orders in exceptional cases, for example due to delivery issues, incorrect stock information or obvious pricing errors. 

5. Payment Methods and Retention of Title

  • Accepted payment methods are displayed during checkout and may include Twint, credit card or advance payment. 
  • Delivery generally takes place only after successful receipt of payment. 
  • Any fees charged by payment service providers are displayed during the ordering process. 
  • The delivered products remain the property of Patrisol GmbH until full payment has been received. 

6. Delivery and Delivery Times

  • Deliveries are made to addresses within Switzerland and Liechtenstein. 
  • Depending on the product, shipping is carried out either by parcel service or freight forwarding company. 
  • Delivery times are indicated where possible on the product page or during checkout. 
  • Delivery times are estimates only and are not binding. 
  • Delivery delays do not result in any claims for damages or an automatic right to withdraw from the contract. However, should a delivery be delayed by more than 4 weeks beyond the non-binding standard delivery time, the customer is entitled to withdraw from the contract free of charge after setting a reasonable grace period in writing via email.  
  • Delivery times may be extended for products that are not in stock or for pre-orders. 
  • In the event of delivery delays, customers will be informed by e-mail where possible. 
  • Payments already made for unavailable products will be refunded. 
  • Unless otherwise agreed, freight forwarding deliveries are made curbside only. 
  • Transport of the goods to the final place of use as well as disposal of packaging materials, pallets or protective materials is the responsibility of the customer. 
  • If the customer refuses acceptance of the delivery or fails to collect the goods within the pickup period, harialy.ch reserves the right to cancel the contract and charge the customer for return transport, storage or additional delivery attempts. 

7. Inspection of Goods and Complaints

  • Deliveries should be inspected immediately upon receipt, especially for visible transport damage or incorrect items. 
  • If the delivered goods show visible transport damage, incorrect products, or missing parts, this must be reported to us as quickly as possible, ideally within 3 working days of receipt of the delivery, via email. After this period, the delivery is deemed approved, unless it involves hidden defects.  
  • Hidden defects must be reported via email immediately upon discovery.  
  • An appropriate solution will be sought together with the customer, such as replacement, repair or refund.  
  • In the case of visible transport damage, customers are also advised to notify the delivery service directly.  

8. Returns and Return Shipments

  • Swiss law does not provide a statutory right of withdrawal for online purchases. 
  • harialy.ch does not grant a voluntary right of return for dislike, incorrect orders, or deviating personal expectations. The provisions regarding defects, transport damage, or incorrect deliveries (pursuant to Section 7) remain unaffected by this.  
  • Returns are accepted only after prior agreement. 
  • After written confirmation of the return by harialy.ch, the goods must be returned within 14 days. 
  • Products should be returned unused, clean and, where possible, in their original packaging. 
  • Assembled, used, damaged or soiled products may be excluded from return. 
  • Return shipping costs are generally borne by the customer unless the product is defective or incorrectly delivered. 
  • Additional return transport costs may apply for large products or freight forwarding deliveries. 

9. Warranty

  • All products are generally covered by a warranty period of 2 years from the delivery date. 
  • The warranty covers material and manufacturing defects under normal and proper use. 
  • In the event of justified defects, harialy.ch may choose between repair, replacement, price reduction or refund. 
  • Normal wear and tear, signs of use, weather-related effects, UV-related changes, material ageing and damage caused by improper use or incorrect care are excluded from the warranty. 
  • Instructions provided by the respective manufacturers regarding use, care and storage must be followed. 
  • Further warranty or guarantee claims exist only where required by law or expressly confirmed in writing. 

10. Data Protection

  • Personal data is treated confidentially and used only for processing orders and customer enquiries. 
  • Data is shared with service providers only to the extent necessary for shipping, payment processing or technical operations. 
  • Further information regarding the handling of personal data can be found in the separate privacy policy. 

11. Product Use and Care

  • Outdoor products should be used and maintained according to the manufacturer’s instructions. 
  • Weather, UV exposure, humidity, temperature fluctuations or improper storage may affect materials and colours. 
  • No liability is accepted for damage caused by improper use or storage. 

12. Liability

  • harialy.ch works with care to provide high-quality products and reliable delivery. 
  • Liability exists only for damages caused intentionally or through gross negligence. 
  • Any further liability is excluded to the extent permitted by law. 

13. Severability Clause

  • Should individual provisions of these Terms and Conditions become invalid or incomplete, the validity of the remaining provisions shall remain unaffected. 
  • The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the original provision. 

14. Applicable Law and Jurisdiction

  • All contractual relationships are governed by Swiss law. 
  • Place of jurisdiction is Kreuzlingen TG, Switzerland. 
  • Mandatory legal provisions regarding consumer jurisdiction remain reserved.
